ACCEPTABLE USE AND MESSAGING POLICY
LIFT Marketing System
Effective Date: January 1, 2026
This Acceptable Use and Messaging Policy (“Policy”) governs use of the websites, applications, and services provided by LIFT Growth Systems LLC, doing business as LIFT Marketing System (“Company,” “we,” “us,” “our”), including the LIFT CRM platform.
This Policy is incorporated by reference into the Terms of Service. Violation of this Policy may result in immediate suspension or termination of messaging features or full account access.
1. Purpose of This Policy
LIFT Marketing System provides messaging and automation tools that operate within regulated environments governed by laws, carrier rules, and third-party provider requirements.
This Policy exists to:
- Protect platform integrity and deliverability
- Maintain carrier and provider relationships
- Reduce legal and compliance risk
- Set clear enforcement expectations
2. General Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Engage in fraud, deception, or misrepresentation
- Harass, threaten, intimidate, or abuse others
- Upload or transmit malware, malicious code, or harmful content
- Interfere with platform operations, security, or performance
- Reverse engineer, decompile, scrape, or extract platform data or software
- Circumvent safeguards, rate limits, or enforcement mechanisms
- Share credentials or allow unauthorized account access
- Use the Services to provide services to third parties as a reseller, agency, or bureau without written approval
3. Messaging Responsibility
The LIFT CRM platform enables email, SMS, MMS, voicemail, and other communications.
You are solely responsible for:
- Compliance with TCPA, CAN-SPAM, state laws, and international laws where applicable
- Compliance with carrier rules and provider requirements
- Obtaining and maintaining legally valid consent before sending messages
- Providing required disclosures, identification, and opt-out mechanisms
- Honoring opt-out and suppression requests immediately
- Maintaining proof of consent where required
LIFT Marketing System does not verify consent and does not provide legal advice.
4. Prohibited Messaging Practices
The following practices are prohibited and may result in immediate enforcement action:
- Sending messages without required consent
- High complaint, spam, or opt-out rates
- Deceptive, misleading, or false messaging
- Harassing, threatening, or abusive content
- Messaging related to illegal activity
- Repeated messaging to non-responsive recipients
- Attempts to evade carrier filtering, detection, or enforcement
- Artificial warming, traffic masking, or traffic laundering
- Manipulating sender identities or domains to bypass restrictions
5. High-Risk Contact Lists
Purchased, scraped, rented, or third-party contact lists are inherently high risk.
If you choose to use such lists:
- You do so entirely at your own risk
- You are responsible for consent and legality
- Provider or carrier enforcement actions may occur without notice
LIFT Marketing System is not liable for messaging disruptions, suspensions, or losses resulting from use of high-risk lists.
6. Provider and Carrier Enforcement
Messaging and email delivery rely on third-party providers and carrier networks.
You acknowledge that:
- Providers and carriers may restrict, throttle, suspend, or terminate messaging
- Enforcement may occur without advance notice
- LIFT Marketing System may be required to take action to protect platform standing
We reserve the right to suspend messaging features immediately to prevent harm to the platform or provider relationships.
7. Monitoring and Enforcement
We may monitor usage patterns to identify violations of this Policy.
Enforcement actions may include:
- Temporary or permanent suspension of messaging features
- Account suspension or termination
- Reporting violations to providers or carriers when required
- Refusal of future service
Enforcement decisions are made to protect the Services and are final.
8. Relationship to Other Policies
This Policy supplements and does not replace:
- Terms of Service
- Privacy Policy
- Data Processing Addendum
- Service Description or Product Addenda
In the event of a conflict, the Terms of Service control.
9. Changes to This Policy
We may update this Policy at any time.
Continued use of the Services after changes constitutes acceptance of the updated Policy.
